Aiming to enhance job mobility and foster innovation, the Federal Trade Commission (FTC) has announced a final rule to ban noncompete agreements nationwide.

These agreements have been identified as hindrances to wage growth, innovation, and entrepreneurial activity, according to FTC Chair Lina Khan.

The rule is projected to lead to the creation of over 8,500 new businesses annually and increase average worker earnings by $524 per year, while also reducing healthcare costs by up to $194 billion over the next decade.

Additionally, the FTC says it is anticipated to stimulate innovation, resulting in an estimated 17,000 to 29,000 more patents filed yearly over the next decade.

  4. Be Prepared and Polite: Enter the discussion prepared with relevant information and be respectful in your approach. Emphasize your commitment to the company while expressing your concerns about the noncompete agreement.

  5. Highlight the Ruling's Impact: Explain how the FTC ruling affects your ability to pursue new opportunities and how it aligns with the goal of promoting competition and innovation.

  6. Seek Clarification: Ask for clarification on how the company plans to adapt to the new ruling and whether any changes will be made to existing agreements.

  7. Propose Solutions: If applicable, suggest alternative arrangements that address the company's concerns while allowing you more flexibility in your career choices.

  8. Follow Up in Writing: After the meeting, consider sending a follow-up email summarizing the discussion and any agreements or action items agreed upon.

  9. Know Your Rights: Familiarize yourself with your legal rights regarding noncompete agreements in your jurisdiction. If necessary, seek legal advice to understand your options.

  10. Stay Professional: Regardless of the outcome, maintain a professional demeanor throughout the process. Your goal is to have a constructive dialogue and find a mutually beneficial solution.
